Lesting, W.: Das Delegationsverbot des gerichtlichen Sachverständigen – Einzelartikel aus R&P 1/2021

Ein gerichtlicher Sachverständiger ist verpflichtet, den Gutachtenauftrag persönlich zu erfüllen. Ein Verstoß gegen die Pflicht zur eigenverantwortlichen Erstattung des Gutachtens kann zum Verlust des Vergütungsanspruchs führen. Das beauftragende Gericht und der (voraussichtliche) Sachverständige sind deshalb gut beraten, absehbare Schwierigkeiten hinsichtlich der Qualifikation, des Abgabezeitpunkts oder Auftragsinhalts offen und rechtzeitig zu kommunizieren. Dies ermöglicht es dem Gericht, den Gutachtenauftrag gegebenenfalls zu ändern oder zu präzisieren; dem Sachverständigen bleiben Missverständnisse und Konflikte erspart.

Personal Obligations and Delegation in Medico-legal Expert Opinions

A judicial expert is obliged to personally carry out the expert report. A breach of the obligation to produce the expert report on one’s own responsibility can lead to the loss of the entitlement to remuneration. The commissioning court and the (prospective) expert are therefore well advised to communicate foreseeable difficulties with regard to qualification, the submission time or the content of the order openly and in good time. This enables the court to change or specify the expert opinion if necessary; the expert is spared misunderstandings and conflicts.
